End User License Agreement

1. Acceptance of Terms

By downloading, installing, or using Hay or Neigh ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App. You must be 18 years of age or older to create an account and use the App.

2. License Grant

Kevin Stewart grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. This license does not include the right to:

• Reproduce, distribute, or publicly display the App
• Modify, reverse engineer, or create derivative works
• Use the App for any commercial purpose without written consent
• Remove any copyright or proprietary notices

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Provide accurate and truthful registration information
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activity that occurs under your account
• Not share your account with others or create accounts on behalf of others

4. User-Generated Content

The App allows users to submit items and images ("User Content"). By submitting User Content, you:

• Represent that you have the right to submit such content
• Grant Kevin Stewart a worldwide, royalty-free license to use, display, and distribute your content within the App
• Acknowledge that all submissions are subject to review and may be rejected or removed
• Agree that approved content may appear in matchups viewable by all users

5. Prohibited Conduct

You agree NOT to use the App to:

• Submit, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Post content involving nudity, explicit sexual material, or graphic violence
• Harass, bully, intimidate, or harm other users
• Impersonate any person or entity
• Spam, flood, or disrupt the App or its services
• Attempt to gain unauthorized access to any part of the App
• Violate any applicable law or regulation
• Infringe on intellectual property rights of others
• Submit content involving minors in any inappropriate context

6. Content Moderation

We take community safety seriously. Kevin Stewart reserves the right to:

• Review all user-submitted content before it goes live
• Remove any content that violates these terms, without prior notice
• Suspend or permanently ban accounts that violate these terms
• Act on reports of objectionable content within 24 hours

Content reports are reviewed by the developer personally. We have zero tolerance for objectionable content or abusive users.

7. Age Requirement

Hay or Neigh is rated 17+ and is intended for users aged 18 and over. By creating an account, you confirm you are at least 18 years of age. We do not knowingly collect data from users under 18. If we discover an account belongs to a minor, we will immediately terminate the account.

8. Intellectual Property

All content in the App not submitted by users — including the name "Hay or Neigh," the scoring system, design, and code — is owned by Kevin Stewart and protected by copyright and trademark laws.

9. Disclaimers

The App is provided "as is" without warranties of any kind. Kevin Stewart does not warrant that the App will be uninterrupted, error-free, or free of viruses. Use the App at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, Kevin Stewart shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

11. Termination

We may terminate or suspend your account at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately.

12. Changes to These Terms

We reserve the right to modify these terms at any time. We will notify users of material changes through the App. Continued use of the App after changes constitutes acceptance of the new terms.

13. Governing Law

These terms are governed by the laws of the State of Alabama, United States, without regard to conflict of law principles.

Privacy Policy

1. Information We Collect

Information you provide

• Account information: Username, email address, and password (stored as a secure hash)
• Profile information: Optional avatar image
• User-submitted content: Item names and images you submit through the app
• Communications: Messages you send to support

Information collected automatically

• Usage data: Votes, rounds played, matchups viewed, and game activity
• Device information: Push notification token (for optional notifications)
• Log data: Server logs including IP addresses, timestamps, and API requests

2. How We Use Your Information

We use your information to:

• Operate and improve the App
• Authenticate your account and maintain your session
• Track your game progress, points, and achievements
• Deliver push notifications you have opted into
• Review and moderate user-submitted content
• Respond to reports of policy violations
• Communicate important updates about the App
• Comply with legal obligations

3. Information Sharing

We do not sell, rent, or trade your personal information. We may share your information:

• With no one for marketing purposes — ever
• To comply with law: If required by a valid legal process
• To protect rights: If necessary to enforce our terms or protect safety
• With service providers: Our server infrastructure (self-hosted in the United States)

4. Data Retention

We retain your account data for as long as your account is active. Deleted accounts are purged within 30 days. Server logs are retained for up to 90 days. Vote and game history may be retained in anonymized form for analytics purposes.

5. Your Rights

You have the right to:

• Access the personal data we hold about you
• Correct inaccurate information
• Delete your account and associated data
• Export your data in a portable format
• Opt out of push notifications at any time

6. Security

We take reasonable technical and organizational measures to protect your data, including HTTPS encryption for all data in transit, bcrypt password hashing, and JWT-based authentication with 14-day expiry. However, no method of transmission over the Internet is 100% secure.

7. Children's Privacy

Hay or Neigh is not directed at children under 18. We do not knowingly collect personal information from anyone under 18. If you believe a child has created an account, please contact us and we will immediately delete it.

8. Push Notifications

If you grant notification permission, we may send you alerts about daily challenges, streaks, or app updates. You can disable notifications at any time in your device settings or through the App's profile settings.

9. Third-Party Services

The App does not currently integrate any third-party advertising networks or analytics platforms. App distribution is handled through Apple App Store and Google Play Store, which have their own privacy policies.

10. Changes to This Policy

We may update this policy periodically. We will notify users of material changes through the App. Continued use after changes constitutes acceptance.

Content Policy

1. Our Standards

Hay or Neigh is a community built around friendly opinions and healthy debate. All user-submitted items and activity must align with these standards. We have zero tolerance for objectionable content or abusive users.

2. Prohibited Content

The following content is strictly prohibited and will result in immediate removal and account suspension or permanent ban:

Sexual & Explicit Content

• Nudity or sexually explicit images or descriptions
• Sexual content involving minors under any circumstances
• Suggestive content involving non-consenting individuals

Violence & Harm

• Graphic violence, gore, or injury imagery
• Content that glorifies or promotes self-harm or suicide
• Content that encourages violence against any person or group

Hate & Harassment

• Content that demeans people based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
• Targeted harassment or bullying of specific individuals
• Doxxing or sharing private information about others
• Threatening language directed at any person

Illegal & Harmful

• Content that promotes illegal activities
• Copyrighted material submitted without authorization
• Spam, scams, or fraudulent content
• Malware or phishing attempts

3. Item Submission Standards

All user-submitted items must:

• Be things, places, experiences, or concepts — not people or specific individuals
• Include a clear, accurate image that represents the item
• Have an appropriate name (2–100 characters, no slurs or hate language)
• Belong to an appropriate category
• Not replicate items already in the database

All submissions go through manual review before going live. Approved items earn the submitter 100 points.

4. Reporting Violations

If you encounter content that violates this policy, you can:

• In the app: Use the flag button on any item during gameplay to report it
• Block a user: Use the block feature to stop seeing content from a specific user
• Remove your own content: Delete any item you submitted from your profile
• Email us: support@hayorneighapp.com

5. Our Response Commitment

We are committed to acting on all reports of objectionable content within 24 hours. Our process:

1. Report received and logged
2. Content immediately flagged and hidden from feed pending review
3. Review by developer within 24 hours
4. If violation confirmed: content removed and user warned or banned
5. Reporter notified of outcome

6. Consequences

Violations of this policy may result in:

• First offense: Content removal and written warning
• Repeat offense: Temporary account suspension
• Severe violation: Immediate permanent ban without warning
• Illegal content: Report to appropriate law enforcement

7. Appeals

If you believe your content was removed in error or your account was unfairly actioned, you may appeal by emailing support@hayorneighapp.com with the subject line "Content Appeal." We will review all appeals within 5 business days.
